2. Basic Concepts Used in the Policy

- 2.7 Operator (Data Controller) – a state body, municipal body, legal entity or individual, independently or jointly with other persons organizing and/or carrying out the processing of personal data, as well as determining the purposes of processing personal data, the composition of personal data to be processed, the actions (operations) performed with personal data;
- 2.8 Personal data – any information relating directly or indirectly to an identified or identifiable User of the website https://smmpirat.com;
- 2.9 User – any visitor to the website https://smmpirat.com;
- 2.10 Provision of personal data – actions aimed at disclosing personal data to a certain person or a certain circle of persons;
- 2.11 Dissemination of personal data – any actions aimed at disclosing personal data to an indefinite circle of persons (transfer of personal data) or familiarizing an unlimited circle of persons with personal data, including the publication of personal data in the media, placement in information and telecommunication networks, or providing access to personal data in any other way;

- 2.17 Phone number;
- 2.18 The site also collects and processes anonymized data about visitors (including "cookie" files) using internet statistics services (e.g., Google Analytics and others).
- 2.19 The above data are hereinafter collectively referred to as Personal Data.
3. Purposes of Personal Data Processing
- 3.1 The purpose of processing the User's personal data is to conclude, execute, and terminate civil law contracts; to provide the User with access to services, information and/or materials contained on the website https://smmpirat.com; to clarify order details; and to communicate with the User regarding their orders and inquiries.

- 5.2 The Operator ensures the safety of personal data and takes all possible measures to exclude access to personal data by unauthorized persons.
- 5.3 Transfer of Personal Data to Third Parties and Government Authorities
- The Operator undertakes to maintain the confidentiality of the User's personal data and not to disclose it to third parties without the User's consent, except as provided below.
- The Operator has the right to transfer the User's personal and other data to third parties in the following cases:
- To fulfill the Agreement (Offer) – to payment aggregators, hosting providers, analytics services (Google Analytics, etc.) in an anonymized form or to the extent necessary for them to perform their functions.
- Upon a duly executed official request from courts, law enforcement agencies, or other authorized government bodies in cases and in the manner provided for by applicable law.
- To protect the rights, legitimate interests, property, and safety of the Operator, other Users, or third parties, in particular when facts or reasonable suspicions are identified that the User has committed actions violating the terms of the Offer or applicable law.
- Note: Links to accounts, pages, posts on social networks and other internet platforms provided by the User as order parameters for the provision of Services, are not considered personal data in the context of this section. These are necessary technical details for performing the work. The Operator does not request, process, or store the User's logins and passwords for accounts on third-party platforms.
- 5.4 If inaccuracies in personal data are detected, the User can update them independently by sending a notification to the Operator via email to privacy@smmpirat.com with the subject line "Personal Data Update".
- 5.5 The period for processing personal data is unlimited, but in any case no longer than necessary for the purposes for which the data was collected. The User may at any time withdraw their consent to the processing of personal data by sending a notification to the Operator via email to privacy@smmpirat.com with the subject line "Withdrawal of consent to the processing of personal data". Withdrawal of consent may entail the deletion of the User's account and all related data, except in cases where the Operator is entitled or obliged to retain data in accordance with applicable law. Please note that withdrawal of consent may make it impossible to continue using the Service.
6. Cross-Border Transfer of Personal Data
- 6.1 Before starting the cross-border transfer of personal data, the Operator is obliged to ensure that the foreign state to whose territory the transfer of personal data is intended provides adequate protection of the rights of personal data subjects, or that other appropriate safeguards (such as Standard Contractual Clauses) are in place.
- 6.2 Cross-border transfer of personal data to the territories of foreign states that do not meet the above requirements may only be carried out if there is written consent of the personal data subject to the cross-border transfer of their personal data and/or for the performance of a contract to which the personal data subject is a party.

- 7.2 This document will reflect any changes to the Operator's personal data processing policy. The Policy is valid indefinitely until replaced by a new version.
